Stern Law Representing Thousands in Faulty Transmission Claims

The dedicated consumer rights attorneys at Stern Law are currently involved in a mass action against Ford for its Fiesta and Focus transmissions and are organizing another mass action regarding Ford’s Fusion transmission. If you own or lease a 2010-2016 Ford Fusion and have experienced transmission-related issues, contact our firm today to discuss your potential for seeking damages.

Ford’s Faulty Transmissions

As America became more fuel-conscious, Ford tried to meet the new demand for better gas mileage by creating an automatic-manual hybrid transmission. Manual transmissions are more fuel efficient, which is highly attractive in light of fuel standards and increased prices at the pump, but automatic transmissions have greater mass appeal. The ease and convenience of an automatic transmission fit better into the lives of more American consumers.

Ford’s PowerShift transmission, outfitted in the Fiesta starting in 2010 and the Focus in 2012, combined the two. This new design makes an automatic shifter out of a manual transmission by using a computer-controlled “dry clutch” in place of the oil-fed shifting mechanism of a standard transmission. Because no oil is supplied during a shift, the otherwise-manual mechanism endures rapid wear and tear, and the computer module becomes overloaded trying to handle accelerations and speed changes, causing dangerous issues for the driver.

Our Consumer Litigation

When we heard about the problems so many Fiesta and Focus owners were having, we knew we needed to take action. We created and filed a mass action against Ford for its continued use of the faulty PowerShift transmission systems. In this action, we alleged Ford knowingly manufactured and failed to correct a defective transmission.

While the deadline has passed to participate in our Fiesta and Focus mass action, we are now organizing a mass action against Ford related to its Fusion transmissions. Though the Fusion does not have the same PowerShift transmission, Fusion owners are experiencing many of the same transmission issues and not finding a fix at the service department.

State “Lemon Laws” and the national Magnuson-Moss Warranty Act allow us to sue Ford in a mass consumer protection action in which we fight for the rights of car owners who have been misled by the vehicle manufacturer.

Is This a Class Action?

Stern Law’s Fusion mass action is not a class action. In a class action, all claimants are represented by just one or a few plaintiffs, and everyone is part of the same, single lawsuit. In a mass action, every plaintiff has his or her own claim. Your Stern Law claim will be valued based on its own merit, rather than the merit of anyone else’s claim. If you receive a settlement, it will be a real settlement, not a $500 class action coupon that was not worth your time in the first place.
